General Terms and Conditions of Use and Contracting

These General Terms and Conditions of Use and Contracting (hereinafter, “the General Conditions”) govern the access and use of the BLUE SOUNDS website accessible through the domain name blue-sounds.com, as well as its subdomains (hereinafter, “the Website”), including the contracting of products through it. The simple access to the Website attributes to the person who performs it the condition of user of the same (hereinafter, "the User").

By accepting these General Conditions, the User states:

a) That have read, understand, and accept what is stated here.
b) That, in the event that it is arranged to contract a product and/or service, it has sufficient capacity to do so.
c) That it is of legal age.

2. Access to the Website

Simple access to the Website is free except for the cost of the connection through the telecommunications network provided by the access provider contracted by the User.

3. Contents and services linked through the Website

The Website may contain technical link devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, BLUE SOUNDS will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of their illegality and has not deactivated the link to them with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, they can notify BLUE SOUNDS.

In no case should the existence of Linked Sites presuppose the formalization of agreements between BLUE SOUNDS and those responsible or owners thereof, as well as the recommendation or promotion of the Linked Sites and/or their contents by BLUE SOUNDS. Unless expressly stated otherwise on the Website, BLUE SOUNDS do not know the contents and services of the Linked Sites and, therefore, is not responsible for the damages that these may cause to the User or to any third party.

4. Intellectual and industrial property

All the contents of the Website, understood by them, including but not limited to, the texts, photographs, graphics, images, icons, technology, software, links and other audio-visual or sound content, as well as their graphic design and source codes, are the intellectual property of BLUE SOUNDS or third-party licensors, and none of the exploitation rights recognized by current regulations on intellectual property over them may be understood to be assigned to the User.

The trademarks, trade names and other distinctive signs published on the Website are owned by BLUE SOUNDS or third-party transferors and/or licensors, without any right over them being understood to have been assigned to the User.

5. Contracting of products

5.1. Main characteristics of the goods

The main characteristics of the goods offered through the Website can be consulted in the descriptive file with which they are presented.

5.2. Purchase procedure

The language in which the contract can be formalized is English.

The procedure to buy products through the Website is as follows:

1. From the tab of the desired product, the User must click on the “Buy” button to add it to the shopping cart. The User will be able to view the total price of the selected product, including the applicable shipping costs. To continue with the purchase process, the User must click on the "Proceed to checkout" button.
2. The User may remove products from the shopping cart or modify the amount of product initially selected. If the User has a discount coupon, he may enter it at this time. To continue with the purchase process, the User must click on the "Continue" button.

For these purposes, access to restricted areas and/or the use of the services and contents of the Website made under your password will be deemed to have been made by the User.

5.4. Correction and identification of errors in data entry

When the User forgets to correctly fill in any information indicated as mandatory in the corresponding form, they will not be able to advance in the contracting or validation process until they have completed it. An on-screen message will warn you of this circumstance.

5.5. Delivery of orders

6. Right of withdrawal

6.1. Exercise period

The User has the right to withdraw from the contract entered into through the Website within a period of 14 calendar days without the need for justification.

In the case of a sales contract, the withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by him, other than the carrier, has acquired material possession of the goods.

In the event of a contract for the delivery of multiple goods ordered by the User in the same order and delivered separately, the withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by him, other than the carrier, has acquired the material possession of the last of those goods.

In case of delivery of a good composed of multiple components or pieces, the withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by him, other than the carrier, has acquired material possession of the last component or part.

To exercise the right of withdrawal, the User must notify BLUE SOUNDS of his decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax, or email). The User can use the downloadable withdrawal form model here, although its use is not mandatory.

To meet the withdrawal period, it is sufficient that the User's communication regarding the exercise of this right is sent before the corresponding period expires.

6.2. Consequences of withdrawal

In the event of withdrawal, BLUE SOUNDS will return all payments received from the User, including delivery costs (with the exception of additional costs resulting from the User's choice of a delivery method other than the less expensive mode of ordinary delivery offered by BLUE SOUNDS) without any undue delay and, in any case, no later than 14 calendar days from the date on which the User informs BLUE SOUNDS of their decision to withdraw from the contract. BLUE SOUNDS will proceed to make said reimbursement using the same means of payment used by the User for the initial transaction, unless another option has been expressly provided; in any case, the User will not incur any expense as a result of the refund. BLUE SOUNDS may withhold the refund until the goods have been received, or until the User has submitted proof of their return, depending on which condition is met first.

The User must return or deliver the goods directly to BLUE SOUNDS, without any undue delay and, in any case, no later than 14 calendar days from the date on which they communicate their decision to withdraw from the contract. The term will be considered fulfilled if you return the goods before said term has expired. The User must bear the direct cost of returning the goods.

The User will only be responsible for the decrease in value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics, and operation of the goods.

6.3. Cases of non-application of the right of withdrawal

In accordance with the provisions of article 103 of Royal Legislative Decree 1/2007, of November 16th, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, the User hereby is informed that he may not withdraw from contracts for the supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the User after delivery.

7. Complaints, claims and requests for information

The User can direct their complaints, claims and/or requests for information to BLUE SOUNDS, using any of the following ways:

b) Sending an email to info@blue-sounds.com.

c) By calling 93 280 60 28 from 17:00h to 20:00h, Monday through Friday except holidays.

BLUE SOUNDS has official complaint/claim/request sheets that the User can request.

8. Legal guarantee of conformity for products

The User is reminded that, in accordance with the provisions of articles 114 and following of Royal Legislative Decree 1/2007, of November 16th, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, all products delivered by BLUE SOUNDS must be in accordance with the contract entered into, with BLUE SOUNDS responding to the User for the lack of conformity that manifests itself within a period of two years from the delivery of the product.

Where appropriate, the lack of conformity that results from an incorrect installation of the product will be equated to the lack of conformity of the product when the faulty installation has been carried out by the User due to an error in the installation instructions.

The scope and form of execution of the rights conferred on the User by said legal guarantee can be consulted in articles 114 and following of the aforementioned regulation.

9. Nullity and ineffectiveness of the clauses

If any clause included in these General Conditions were declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part of it that is null or ineffective, these General Conditions subsisting in everything else and considering such disposition totally or partially by not included.

10. Applicable legislation and competent jurisdiction

These General Conditions will be governed and interpreted in accordance with Spanish legislation.

In case of controversy, the User may choose to file his claim with the Courts or Tribunals that correspond to his domicile.

11. Alternative resolution of consumer disputes

The User is informed about the existence of the online dispute resolution platform of the European Union, which can be accessed here.


Condiciones Generales de Uso y Contratación

Estas Condiciones Generales de Uso y Contratación (en adelante, “las Condiciones Generales”) rigen el acceso y la utilización del sitio web BLUE SOUNDS accesible a través del nombre de dominio blue-sounds.com, así como sus subdominios (en adelante, “el Sitio Web”), incluyendo la contratación de productos a través del mismo. El simple acceso al Sitio Web atribuye a quien lo realiza la condición de usuario del mismo (en adelante, “el Usuario”).

Por medio de la aceptación de estas Condiciones Generales el Usuario manifiesta:

a) Que ha leído, entiende y acepta lo aquí expuesto.
b) Que, en caso de que se disponga a contratar algún producto y/o servicio, tiene capacidad suficiente para ello.
c) Que es mayor de edad.

2. Acceso al Sitio Web

El simple acceso al Sitio Web es gratuito salvo en lo relativo al coste de la conexión a través de la red de telecomunicaciones suministrada por el proveedor de acceso contratado por el Usuario.

3. Contenidos y servicios enlazados a través del Sitio Web

El Sitio Web puede contener dispositivos técnicos de enlace, directorios e incluso instrumentos de búsqueda que permitan al Usuario acceder a otras páginas y portales de Internet (en adelante, “Sitios Enlazados”). En estos casos, BLUE SOUNDS sólo será responsable de los contenidos y servicios suministrados en los Sitios Enlazados en la medida en que tenga conocimiento efectivo de su ilicitud y no haya desactivado el enlace a los mismos con la diligencia debida. En el supuesto de que el Usuario considere que existe un Sitio Enlazado con contenidos ilícitos o inadecuados, puede comunicarlo a BLUE SOUNDS.

En ningún caso la existencia de Sitios Enlazados debe presuponer la formalización de acuerdos entre BLUE SOUNDS y los responsables o titulares de los mismos, así como tampoco la recomendación o promoción de los Sitios Enlazados y/o sus contenidos por parte de BLUE SOUNDS. A menos que se indique expresamente lo contrario en el Sitio Web, BLUE SOUNDS no conoce los contenidos y servicios de los Sitios Enlazados y, por tanto, no se hace responsable por los daños y perjuicios que éstos puedan producir al Usuario o a cualquier tercero.

4. Propiedad intelectual e industrial

Todos los contenidos del Sitio Web entendiendo por éstos, a título meramente enunciativo pero no exhaustivo, los textos, fotografías, gráficos, imágenes, iconos, tecnología, software, links y demás contenidos audiovisuales o sonoros, así como su diseño gráfico y códigos fuente, son propiedad intelectual de BLUE SOUNDS o de terceros licenciadores, sin que puedan entenderse cedidos al Usuario ninguno de los derechos de explotación reconocidos por la normativa vigente en materia de propiedad intelectual sobre los mismos.

Las marcas, nombres comerciales y demás signos distintivos publicados en el Sitio Web son titularidad de BLUE SOUNDS o de terceros cedentes y/o licenciadores, sin que pueda entenderse cedido al Usuario ningún derecho sobre los mismos.

5. Contratación de productos

5.1. Características principales de los bienes

Las características principales de los bienes ofrecidos a través del Sitio Web pueden consultarse en la propia ficha descriptiva con la que se presentan.

5.2. Procedimiento de compra

La lengua en la que puede formalizarse la contratación es la inglesa.

El procedimiento para comprar productos a través del Sitio Web es el siguiente:

1. Desde la ficha del producto deseado, el Usuario deberá hacer clic en el botón “Buy” para añadirlo al carrito de compra. El Usuario podrá visualizar el precio total del producto seleccionado, incluyendo los gastos de envío aplicables. Para continuar con el proceso de compra, el Usuario deberá hacer clic en el botón “Proceed to checkout”.
2. El Usuario podrá eliminar productos del carrito de compra, o bien modificar la cantidad de producto inicialmente seleccionada. Si el Usuario dispone de un cupón de descuento, podrá introducirlo en este momento. Para continuar con el proceso de compra, el Usuario deberá hacer clic en el botón “Continue”.

5.3. Contraseña

El Usuario es responsable en todo momento de la custodia de su contraseña, asumiendo en consecuencia cualesquiera daños y perjuicios que pudieran derivarse de su uso indebido, así como de la cesión, revelación o extravío de la misma. A estos efectos, el acceso a áreas restringidas y/o el uso de los servicios y contenidos del Sitio Web realizado bajo su contraseña se reputarán realizados por el Usuario.

5.4. Corrección e identificación de errores en la introducción de datos

Cuando el Usuario olvide cumplimentar correctamente algún dato señalado como obligatorio en el correspondiente formulario, no podrá avanzar en el proceso de contratación o validación hasta haberlo cumplimentado. Un mensaje en pantalla le advertirá de dicha circunstancia.

El Usuario cuyo pedido deba ser entregado en territorio europeo lo recibirá en un plazo aproximado de 5-7 días contados a partir de la fecha de compra. Para pedidos que deban entregarse fuera de territorio europeo debe consultarse previamente el plazo de entrega.

5.6. Precio, modalidades de pago y gastos de envío

Los precios que se indican respecto a cada producto en su correspondiente ficha incluyen, salvo indicación expresa en contra, el Impuesto sobre el Valor Añadido (IVA) y, en todo caso, se expresan por defecto en moneda Euro (€), si bien se posibilita la consulta del cambio aproximado del día en las monedas Dollar Estadounidense ($) y Libra Esterlina (£). 6. Derecho de desistimiento

6.1. Plazo de ejercicio

El Usuario tiene derecho a desistir del contrato celebrado a través del Sitio Web en un plazo de 14 días naturales sin necesidad de justificación.

En caso de un contrato de venta, el plazo de desistimiento expirará a los 14 días naturales del día en que el Usuario o un tercero por él indicado, distinto del transportista, haya adquirido la posesión material de los bienes.

En caso de un contrato de entrega de múltiples bienes encargados por el Usuario en el mismo pedido y entregados por separado, el plazo de desistimiento expirará a los 14 días naturales del día en que el Usuario o un tercero por él indicado, distinto del transportista, haya adquirido la posesión material del último de esos bienes.

En caso de entrega de un bien compuesto por múltiples componentes o piezas, el plazo de desistimiento expirará a los 14 días naturales del día en que el Usuario o un tercero por él indicado, distinto del transportista, haya adquirido la posesión material del último componente o pieza.

Para ejercer el derecho de desistimiento el Usuario deberá notificar a BLUE SOUNDS su decisión de desistir del contrato a través de una declaración inequívoca (por ejemplo, una carta enviada por correo postal, fax o correo electrónico). El Usuario puede utilizar el modelo de formulario de desistimiento descargable aquí, aunque su uso no es obligatorio.

Para cumplir el plazo de desistimiento, basta con que la comunicación del Usuario relativa al ejercicio de este derecho sea enviada antes de que venza el plazo correspondiente.

6.2. Consecuencias del desistimiento

En caso de desistimiento, BLUE SOUNDS devolverá todos los pagos que haya recibido del Usuario, incluidos los gastos de entrega (con la excepción de los gastos adicionales resultantes de la elección por parte del Usuario de una modalidad de entrega diferente a la modalidad menos costosa de entrega ordinaria que ofrezca BLUE SOUNDS) sin ninguna demora indebida y, en todo caso, a más tardar 14 días naturales a partir de la fecha en la que el Usuario informe a BLUE SOUNDS de su decisión de desistir del contrato. BLUE SOUNDS procederá a efectuar dicho reembolso utilizando el mismo medio de pago empleado por el Usuario para la transacción inicial, a no ser que se haya dispuesto expresamente otra opción; en todo caso, el Usuario no incurrirá en ningún gasto como consecuencia del reembolso. BLUE SOUNDS podrá retener el reembolso hasta haber recibido los bienes, o hasta que el Usuario haya presentado una prueba de la devolución de los mismos, según qué condición se cumpla primero.

El Usuario deberá devolver o entregar directamente los bienes a BLUE SOUNDS, sin ninguna demora indebida y, en cualquier caso, a más tardar en el plazo de 14 días naturales a partir de la fecha en que comunique su decisión de desistimiento del contrato. Se considerará cumplido el plazo si efectúa la devolución de los bienes antes de que haya concluido dicho plazo. El Usuario deberá asumir el coste directo de devolución de los bienes.

El Usuario sólo será responsable de la disminución de valor de los bienes resultante de una manipulación distinta a la necesaria para establecer la naturaleza, las características y el funcionamiento de los bienes.

6.3. Supuestos de no aplicación del derecho de desistimiento

De conformidad con lo previsto en el artículo 103 del Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, se informa al Usuario de que no podrá desistir de los contratos de suministro de grabaciones sonoras o de vídeo precintadas o de programas informáticos precintados que hayan sido desprecintados por el Usuario después de la entrega.

7. Quejas, reclamaciones y solicitudes de información

El Usuario puede dirigir sus quejas, reclamaciones y/o solicitudes de información a BLUE SOUNDS, utilizando para ello cualquiera de las siguientes vías:

a) Enviando un escrito a BLUE SOUNDS, calle Benet i Mateu, 26, 08034 – Barcelona.

b) Enviando un correo electrónico a la dirección info@blue-sounds.com

c) Llamando al teléfono 93 280 60 28 en horario de 17:00h a 20:00h, de lunes a viernes excepto festivos.

BLUE SOUNDS dispone de hojas oficiales de queja/reclamación/denuncia que el Usuario puede solicitar.

8. Garantía legal de conformidad para los productos

Se recuerda al Usuario que, de conformidad con lo previsto en los artículos 114 y siguientes del Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, todos los productos entregados por BLUE SOUNDS deben resultar conformes con el contrato celebrado, respondiendo BLUE SOUNDS frente al Usuario por las faltas de conformidad que se manifiesten en un plazo de dos años desde la entrega del producto.

En su caso, la falta de conformidad que resulte de una incorrecta instalación del producto se equiparará a la falta de conformidad del producto cuando la instalación defectuosa la haya realizado el Usuario por culpa de un error en las instrucciones de instalación.

El alcance y forma de ejecución de los derechos que confiere al Usuario dicha garantía legal pueden ser consultados en los artículos 114 y siguientes de la citada norma.

9. Nulidad e ineficacia de las cláusulas

Si cualquier cláusula incluida en estas Condiciones Generales fuese declarada total o parcialmente nula o ineficaz, tal nulidad o ineficacia tan sólo afectará a dicha disposición o a la parte de la misma que resulte nula o ineficaz, subsistiendo estas Condiciones Generales en todo lo demás y considerándose tal disposición total o parcialmente por no incluida.

10. Legislación aplicable y jurisdicción competente

Estas Condiciones Generales se regirán e interpretarán conforme a la legislación española.

En caso de controversia, el Usuario puede optar por interponer su demanda ante los Juzgados o Tribunales que correspondan a su domicilio.

11. Resolución alternativa de litigios en materia de consumo
